1. Who these terms are between

This website (thelakesatstdavid.com, the “Site” or this “Website”) is operated by the Lakes at St. David, LP and its General Partner, St. David Management LLC , doing business as The Lakes at St. David RV Resort (collectively, "we," "us," "our" and the “Owners”), located at 801 S Lee St., St. David, AZ 85630. By accessing or using this website, you ("you" or "your") agree to these Terms of Use. If you don’t agree, you must stop using the Site immediately. Our RV resort is referred to herein as the “Resort.”

2. Use of the website

You may use this Website for lawful, personal, non-commercial purposes — to learn about the resort, view the casitas and activities, and make a reservation. You agree not to:

  • use the Site in any way that violates applicable law;
  • attempt to gain unauthorized access to the Site, its servers, or connected systems;
  • interfere with or disrupt the Site or its security features;
  • scrape, copy, or reproduce Site content except as allowed in Section 4; or
  • use the Site to transmit harmful code or unsolicited communications.

3. Reservations and stays

Reservations are made through our third-party booking provider (the “Booking Provider”), which is currently ResNexus but may be changed at any time without notice. These Terms of Use govern your use of this Website. However, the booking process, including without limitation payment and any cancellation, and any physical stay at or visit to the Resort are separately governed by our applicable policies, as well as any policies or terms of service implemented by the Booking Provider. Rates, availability, and site/casita details shown on the Site are for general information purposes only and may change at any time without notice until confirmed at the time of booking.

4. Intellectual property

We own the content on this site — text, photographs, graphics, logos, and design — or use it with permission, and all such content is protected by applicable intellectual-property laws. You may view and share links to the site, but you may not copy, reproduce, republish, or use our content for commercial purposes without our written permission.

5. Third-party links and services

The Site links to and relies on third-party services, including our Booking Provider, Google (analytics and fonts), map providers, and YouTube (video tours). We don’t control these services and aren’t responsible for their content, availability, or practices. Your use of them is subject to their own terms and policies.

6. Information accuracy & "as is" disclaimer

We work to keep the Site accurate and up to date, but we make no warranties that it is complete, current, or error-free. The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Photographs and descriptions are representative; actual accommodations may vary.

7. Limitation of liability

To the fullest extent permitted by law, the Owners and their respective partners, managers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) this Website. In addition, and to the extent permitted under applicable law, the maximum liability to the Owners and their respective partners, managers, employees, and agents in connection with this Website shall not exceed the greater of $100 or the total booking payments you have made to the Owners in the previous 12 months. Nothing in these Terms of Use shall limit liability that cannot be limited under applicable law.

8. Indemnification

You agree to indemnify and hold harmless the Owners and their respective partners, managers, employees, and agents from claims arising out of your misuse of the Website or your violation of these Terms of Use.

9. Changes to these terms

We may update these Terms of Use from time to time. Changes take effect when posted to the Site, with an updated "Last updated" date. Continued use of the Site means you accept the current terms.

10. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any action to enforce or interpret these Terms of Use may only be made in the state courts located in Cochise County, Arizona.
